Walmart is having a bad week on the labor law front. In addition to the National Labor Relations Board moving ahead with charges that Walmart illegally threatened and retaliatedagainst striking workers, a federal judge in California refused to dismiss a class-action lawsuit brought by warehouse workers against Walmart and Schneider Logistics, meaning they will have to go to trial.
Walmart contracts with Schneider Logistics to run warehouses, and has always said that the workers in the warehouses are Schneider employees with no real connection to Walmart.

In the current case, Schneider also claims not to be legally liable for minimum wage and overtime violations, because the workers are hired and employed through a staffing agency.

But federal district Judge Christina Snyder is saying "not so fast": She's reaffirmed an earlier decision that both Walmart and Schneider should go to trial to determine if they are in fact joint employers of these workers.
Tuesday’s ruling marks the first time a court has ruled there has been enough evidence of Walmart’s “joint employer” status to overcome summary judgment or a motion to dismiss, which requires Walmart to defend itself at trial, according to attorneys for the workers.
“The workers’ day-to-day reality is vindicated by this ruling,” said Theresa Traber of Traber & Voorhees, one of the attorneys representing the plaintiffs, through a statement. “They are subjected to the directions and pressures of Schneider managers as they enforce Walmart’s performance standards on a daily basis.”

That there were serious minimum wage and overtime violations in the Schneider-Walmart warehouse complex isn't in much doubt: a separate case involving workers employed directly by Schneider was already settled for $4.7 million. That's a big reason it's so important for Walmart to deny being the workers' employer at all.

Now they'll have to prove that in court—something that won't be easy, and will probably bring to light a lot of information about how its warehouses work that Walmart would probably prefer remain hidden.


Heard this the other day, great news. Walmart actually ridiculed and taunted the striking workers. First time I've ever seen that.

He's presented no valid argument, has not refuted the numerous studies and facts and respected top economists that point out he is dead wrong.
In his last post, he assembles a fake list of links, which do not support his premise that min wage hurts blacks..mind you, nighthawk is arguing that paying blacks more...hurts them. It's the same bizarre shit as when the retardotarians say that giving blacks food stamps makes them go hungry.
The first 2 nighthawk "links" are to a far rightwing columnist (Sowell) who has recently said Obama is a tyrannical dictator and compared him to Hitler, giving one example where Obama made BP pay for the cleanup after the big oil spill, saying tht's what Hitler would do.
Impressive, huh ? As for his opinions, no studies, no attributions, no links from Sowell.
Link 2 is a buddy of Sowell, another far rightwing columnist/economist, who does the same as Sowell, no attributions, no links to studies, no verification of stats OR direct connection with MW causing actual harm to blacks.
Link3 is an OP-ED from some guy at worldnetdaily, neo-con central, link4 is Sowell again saying the same shit, link 5 is a reporter for the globe waxing stupid with no backup and no mention that that reporter was once fired from the Globe for journalistic misconduct. He made shit up.
That's the quality of Nighty's links.
If you want a real economis'ts views and actual figures from numerous studies over long periods of time, try Robert Reich or Klugman.

Sure, the Right-Wing Conspiracy locked her in this room with Benghazi, promising that he'll ream HCPA in the ass at some point, but there's been nothing, even after months and months and months of one conservative lawmaker or pundit coming in here, with Darrell Issa massaging Benghazi's balls, Sean Hannity offering vigorous analingus and a prostate fingering, and Marco Rubio showing him Libyan porn (which Ted Cruz ended up jacking off to). The best Benghazi's managed is a half-hearted barely-semi-erection back at the end of 2012. Now Lindsey Graham has told everyone to step aside, and he's gonna show how you get a manrocket throbbing. HCPA just rolls her eyes, biding her time.

Look, unless you've got evidence of a deliberate cover-up, unless you've got video of Hillary Clinton personally slitting Stevens' throat while Barack Obama reams his ass as al-Qaeda militants ululate and fire their rifles into the air in praise, the vast majority of us in the United States, the ones who aren't the delusional GOP primary voters, simply don't care.
But, hell, that never stopped the GOP before.

A while back fuelman wrot that many ppl making 40K a yr have no federal tax liability. I challenged that and said it was false.
Today I stopped into a tax place and axed them if Fuelman's statement was true. Turns out it is indeed true.
Under the right circumstances, with many kids and a mtg and business expenses, it's possible to whittle your fed tax rate down to zero.
So I was wrong. I typed without first making myself thoroughly familiar with the issue, and went by what I thought was common sense.
I'm not wrong that often, but in this case fuelman was right and I was wrong.

I actually don't remember sparring with you on this, but if you did ride fuelman's position, then I owe you an apology too. I won't apologize for whatever punches or insults I may have thrown, this is the NHB forum, we're all adults {presumably) and I answer posters in exactly the same way they debate me. ... does not dispute Zimmer's accusation the governor intentionally withheld the bulk of the funding he had control over.

The statement is a non-denial denial. They did not dispute Dawn Zimmer's claim the state government held up millions of dollars in funds. Instead, they used passive tense and other language tricks to let the casual reader assume they did.

Then there is the clearly suspicious redistricting study. With some effort, I found it. LINK


There is also plenty of discussions and even a lawsuit over this indefensible attempt to bias a study's results to help one particular party interested in redevelopment in Hoboken. This happened in the timeframe Dawn Zimmer said it happened.

It defies credibility to believe the Christie staffed Port Authority had nothing to do with influencing this study since they hand-picked the consultants and attempted to setup improper meetings with Port Authority officials while Hoboken was deliberating over whether to accept or reject the study's findings.

Ironically, even the few remaining Christie supporters believe most of Dawn Zimmer's accusations are probably true. It's New Jersey after all. This is how things work.

I don't know if Dawn Zimmer is wearing a White Hat or a Black one. It really doesn't matter. Her actions, including past praise for Christie, is consistent with a desire to do her best for the town she is mayor of. She wouldn't be the first mayor to offer false praise to someone in hopes it will result in funding.

I wouldn't even be surprised if she gave the governor an ultimatum, "release the funding or I go to the press". Again, that would be consistent with her stated desire to do what is best for her town.

It's probably going to get very ugly. And regardless of whether or not her motives are pure. I believe she is telling the truth."

Of course she is, Christie has a long history of this kind of arm-twisting.

I got great raises at that time but the raise put me in a higher tax bracket since there were lot of steps in it and that ladder was never adjusted for inflation. The other problem was that the great raises never equaled the rise of inflation completely. Go and peddel your bilge somewhere where people that lived under the Carter mess are not there.

Reagan was so incompetent that after He took office he lowered taxes and spending and stagflation was history before two years were up. Look at the following graph. I begins at the end of Carter and look at what happened to the % of people having jobs did. Also notice what the Great OBama has done. He has lowered the % of people employed lower than Carter did.

Reagan presided over record high unemployment, and ran up record high debt, after raising taxes multiple times.
Carter was not responsible for stagflation. Reagan made deals with terrorists to keep our hostages, and then sold terrorists arms. Then he illegally created torture squads who killed 1000's of innocent poor people in the lower Americas, and traded arms for funding them, then lied about it.
This is the scumbag you're desperately trying to defend. Fuck off, traitor. I served under Carter, and was proud that he ws our president. Carter is the most highly respected and admired former president.
